This note, in the form of answers to frequently asked questions, offers a brief and basic introduction to the Directive, the Regulations and planning authority responsibilities. The messages are clear:
1.  the Directive is not open to narrow interpretation - the UK Courts will interpret the Directive in the European sense – i.e. as having wide scope and broad purpose;
2.  do not assume a project is excluded simply because it is not expressly mentioned in either the Directive or the Regulations. For example, neither the Directive nor the EIA Regulations refer to specifically "housing development" or “school”. But it would be a mistake to consider that housing development or building a school does not fall within "urban development projects"; and,
3.  where planners are unfamiliar with the EIA Regulations, they should consult with other statutory bodies and, if in doubt, seek legal advice.

In R (on the application of Mortell) v Oldham Metropolitan Borough Council [2007] EWHC 1526 (Admin) the High Court concluded that failure to fully consider EIA criteria before adopting a screening decision that a development fell outside the EIA regulations meant that the decision was invalid and the development's planning permission, granted on the back of that screening decision, was quashed.

The 2008 Regulations recognise that an EIA may be necessary at the Reserved Matters stage. In essence they provide for an EIA to be carried out for a proposed project at reserved matters stage, where either EIA was not carried out at the earlier stage of outline planning permission, or additional significant environmental effects came to light after outline planning permission was granted.

Although the satellite image accessed via this URL is over one year old, it does show the Glebelands toxic dump extending to the north and south of the M4 motorway. It also shows the site’s proximity to the River Usk SSSI (to the west and north of the site) and, to the east, the St Julian’s allotments and a densely populated residential area. The new school is being built on the southern part of the landfill site, where the old running track may still be seen (to the west of the allotments).

At the request of Newport Council, this document sought to dispel concerns raised by the Children's Commissioner about the risks to public health caused by toxic substances released by hazardous waste landfill sites.

In its conclusions, this report states "... the findings of the risk assessment indicate from the data reviewed and collected by URS that there is no reason on human health grounds why the site cannot be redeveloped for the stated purpose once suitable remedial works have been undertaken."

This seems to be saying 'go ahead and build this landfill school' but, importantly, then goes on to say:

"However, in order to make the above conclusion for the site as a whole it is important to ensure we have a high degree of confidence in the data that describes the chemical condition of the landfill ... further data collection is required ..."

It is at this point that we are told that the sampling exercises undertaken to date were insufficient to characterise the site as a whole.  The upshot being that this report was incapable of giving Newport Council the necessary assurances about the suitability of this site for development.

Indeed, the report final paragraph is saying 'the results of further investigations could invalidate our whole report'.  Which is precisely what happened as a result of subsequent and more effective site investigation methods.

This report extract (pages 52 to 71) provides some of the best contaminated land information relating to the north Glebelands. But this is yet another report relying on sampling methods that are inadequate to characterise the site as a whole.

Nevertheless, the findings are very serious and cast doubt on the continued use of the Glebelands in its present condition for recreational purposes.

The findings of this report about the north Glebelands provides the best indication yet of the substances that probably also exist in the fill material in the south Glebelands area. Also provides an indication of the range of pollutants that continue to leach into the River Usk SSSI.

This second newsletter was accompanied by a Newport Council form called 'Questionnaire for Parents' prepared in the style of a Hobson's Choice: 'take it or leave it'.  The newsletter and questionnaire was intended only for the parents of children attending the Durham Road schools. 

Completion of the questionnaire by parents was no doubt based on the biased and misleading information provided on the form itself and within the text of the accompanying newsletter. Of course, Newport Council got the result that they had engineered so carefully.  Newport Council later used the results of this dubious survey of parents to imply that the survey results reflected local views in general.

There will be a 270-place infant school with nursery and 360-place junior school on site. There will also be a flood lit all weather pitch and new community changing facilities. A second access will be provided along Riverside Boulevard to make the school premises more accessible.

"We are on schedule so far and are aiming to stay on track”, said Council Leader Bob Bright.

This might have been a bit premature because the press releases concludes by saying "The project is aiming for a signing date of April 2005, which would allow the school to open by September 2007."

However, it is not clear which members of Newport Council cabinet, if any, have the qualifications necessary to undertake an effective and detailed challenge of their contractors in key technical areas relating to environmental protection and public health. It is not clear that those residents who had raised concerns were present when the contractors were 'challenged' during the meeting.

"It was always a bit embarrassing complaining about Rechem's burning of toxic waste - when the PCBs involved were manufactured in Newport.

"What is worse is the news that Monsanto illegally dumped toxic waste from Newport in a site at Brofiscin quarry, at Groesfaen near Cardiff. Dangerous chemicals are leaking from the site. It could cost £100 million to clean up the chemicals that include the derivative for Agent Orange. PCBs were manufactured up to 1977 in Newport - six years after a ban in the USA.

"The first report of the danger tip was made in 1972 when nine cows died on a local farm. Since then it has been a sad story of delay, cover-up and incompetence."

Some background . . . .

There are several toxic waste dumps in south Wales, some of which have attracted a lot of media attention. Brofiscin Quarry is one such site that, like the Glebelands, has been used to dump PCBs manufactured by Monsanto (now Solutia). Some articles in both the media and professional journals have criticised the work of the Environment Agency and its staff.

The criticism often implies a failure on the part of the Environment Agency to prosecute those responsible for the illegal transfer and dumping of industrial waste.

In the murky world of toxic waste, it appears that you can't always rely on the statutory agencies to protect our environment and public health.
