From: | Mr G Roberts, Principal Planning Officer, Newport City Council | |||||
Date: | 2012-11-26 | Topic: | Request for EIA screening opinion and EIA scoping opinion | View | Prev | Next |
Response to Asbri Planning Limited's request for an EIA scoping opinion.
After 14 years of side-stepping the issue of Environmental Impact Assessment (EIA) for the Glebelands Development, old habits die hard. In its screening opinion, Newport council fails to require the whole Glebelands Development to be subject to EIA, and limits the scope to the proposed residential element only -- despite the fact that, so far, no Environmental Statement (ES) has been provided for the majority of this severely contaminated site. This has all the hallmarks of a classic case of 'salami slicing' - an unlawful practice aimed at splitting a highly impacting project into smaller parts to avoid environmental impact assessment or, as in this case, to reduce the scope of an environmental impact assessment.

Letter from Wales Office on behalf of Cheryl Gillan MP stating that the original
request of 30th August had not been received -
even though this letter makes reference to statements made in that original
request!
This letter also makes an erroneous reference to the Public Services Ombudsman for Wales who is unable to follow up complaints unless the complainant has suffered an unremedied injustice or hardship as a result of an authority's actions. Therefore matters of maladministration and even unlawful actions and decisions by a public body cannot be followed up by the Ombudsman in respect of public interest matters, including matters to do with environmental protection. Anyway, the upshot is that the Secretary of State for Wales is not empowered to make an EIA screening direction in respect of developments in Wales. Next stop: John Griffiths AM . . . .

Letter reiterating that, despite the prohibitive cost of challenging decisions affecting the environment in the UK,
testing the evidence through the courts is the only recourse available to UK citizens. Which, presumably, is why
sustainability; protection of our environment; the health of our neighbours; and good governance is too often
trumped by the actions of developers and civil servants.

A 'thank you' letter to Jessica Morden MP. This letter also suggests that the limited scope of the Public Services Ombudsman
(Wales) Act 2005 appears to leave Newport council free to continue to allegedly disregard, or to circumvent, the
EIA Directive.
Public bodies appear to be immune to the PSO (Wales) Act 2005 unless the complainant has been disadvantaged as an individual, such as a wrongful planning decision directly affecting the complainant. The letter continues "This state of affairs cannot possibly support the promotion of either compliance with Community law or good governance."

Confirms Newport Council's original decision to press ahead with this project without the benefit of an
Environmental Impact Assessment (EIA), but still no justification is given. Appears to imply that "in
hindsight" Newport Council may have made the wrong decision. More significantly, the letter discounts the
social, economic and environmental value of the EIA process - relegating the decision about employing this
important health and environmental protection tool as simply "an operational matter".

This letter states: "With regard to the matter of the Environmental Impact Assessment, the letter dated 21 January 2005, from my colleague Neil Boardman, clearly sets out the relevant legislative background to Environmental Impact Assessment. It was the judgement of myself and my Officers on behalf of the Council that an Environmental Assessment was not required for the development proposed. Both the Council and the relevant statutory Consultees considered that the environmental implications of the development could be assessed satisfactorily from the information supporting the application or through additional investigative work required by planning condition. As you will be aware some of that investigative work is still ongoing and has yet to be submitted formally to the Council for consideration. "I trust that this clarifies the situation for you. An Environmental Assessment is not relevant to the consideration of the reserved matters pursuant to an outline planning permission as advised by Mr Boardman." Also mentions "Rigorous conditions" attached to the original planning permission.

criteria set out in the Town and Country Planning (Environmental Impact Assessment)(England Wales)
Regulations 1999, together with associated Circular 11/99 - Environmental Impact Assessment which needs to
be considered before a decision is reached. These criteria relate to the scale of the development and its
nature, location together with potential impact. On the basis of the submitted information it was determined
that there was no need for an assessment at that time. However, such an assessment can be requested by the

dependant amongst other factors upon the characteristics and scale of the proposed development, sensitivity
of the site and potential impact. It is only if there is the potential for 'significant effects on the

Although the notes may act as a useful aide-memoire, they are not a substitute for the EIA Regulations or for the guidance provided in the official Departmental Circular on EIA (Welsh Office Circular 11/99). This response concluded that the development on the Glebelands does not involve planning issues which would
warrant taking responsibility for determination of the application away from the local planning authority.
Apparently, the National Assembly did not consider the application to involve planning issues of more than
local importance. This response seems to indicate that running a new drainage pipe from the centre of the landfill site into the River Usk SSSI, and the release of airborne contamination while excavating the site and transporting waste through the streets is only expected to impact the local environment and the health of local residents. In effect, the National Assembly were content to ignore the concerns of local residents and leave the decisions to the local authority - the same local authority that was about to grant itself planning permission for this development - despite significant opposition.

effectively pushed those who were permitted to take part into a corner - which probably explains the
