After 14 years of side-stepping the issue of Environmental Impact Assessment (EIA) for the Glebelands Development, old habits die hard. In its screening opinion, Newport council fails to require the whole Glebelands Development to be subject to EIA, and limits the scope to the proposed residential element only -- despite the fact that, so far, no Environmental Statement (ES) has been provided for the majority of this severely contaminated site.

This has all the hallmarks of a classic case of 'salami slicing' - an unlawful practice aimed at splitting a highly impacting project into smaller parts to avoid environmental impact assessment or, as in this case, to reduce the scope of an environmental impact assessment.

This letter also makes an erroneous reference to the Public Services Ombudsman for Wales who is unable to follow up complaints unless the complainant has suffered an unremedied injustice or hardship as a result of an authority's actions. Therefore matters of maladministration and even unlawful actions and decisions by a public body cannot be followed up by the Ombudsman in respect of public interest matters, including matters to do with environmental protection.

Anyway, the upshot is that the Secretary of State for Wales is not empowered to make an EIA screening direction in respect of developments in Wales. Next stop: John Griffiths AM . . . .

Attached to this letter was a summary of the main issues discussed during the training sessions to act an aide-memoire. The writer of the letter requested that it be disseminated widely to planning officers within the recipients's Authority.

Although the notes may act as a useful aide-memoire, they are not a substitute for the EIA Regulations or for the guidance provided in the official Departmental Circular on EIA (Welsh Office Circular 11/99). Apparently, the National Assembly did not consider the application to involve planning issues of more than local importance.

This response seems to indicate that running a new drainage pipe from the centre of the landfill site into the River Usk SSSI, and the release of airborne contamination while excavating the site and transporting waste through the streets is only expected to impact the local environment and the health of local residents.

In effect, the National Assembly were content to ignore the concerns of local residents and leave the decisions to the local authority - the same local authority that was about to grant itself planning permission for this development - despite significant opposition.
