Updated Decision Notice which incorrectly states that Newport Council granted itself outline planning permission with the stated 'standard conditions', on 31 October 2000. In fact, this version was actually created in 2002. It's likely that this version of the Decision Notice was issued unlawfully in order to make covert material changes to the planning permission. "Members considered that monitoring should be regular and effective to ensure the concerns of residents were addressed. This would be undertaken by the Council, including the biodiversity officer, and the developer. Also, the Countryside Council for Wales would monitor the process." Granted, subject to an appropriate and effective programme being utilised to monitor the implementation of the method statement. 06/0169 - Partial Discharge of Conditions 09 and 10 to 00/0768. Outcome of the application was unclear, with the open-ended comment: "To request the Head of Planning and Economic Regeneration to address the concerns of the Ward Members and, if these are adequately addressed by the developer, to determine the application." 06/0170 - Partial Discharge of Condition 06 to 00/0768. Notes the need for an Environmental Impact Assessment (EIA) screening opinion and for that decision to be "recorded in the requisite manner". The Newport council ignored the advice from its own internal Planning Services team, and evaded the legal requirement to screen the development for EIA, thereby failing to issue an EIA screening opinion. The statutory requirement for Newport council to make the development subject to EIA failed at the first hurdle.

This letter provided feedback to councillors concerning the skewed Newport council survey that took place in July 2000. The 'loaded' questionnaire and supporting information (Parent's Newsletter No. 2) excluded the opinions of local residents in general (it was for use by parents only), and failed to present the full range of options. The questionnaire effectively pushed the unrepresentative group of St Julians residents permitted to take part in the survey into a corner - which probably explains the high percentage of 'spoilt' questionnaires.
