| Title: | Note on Environmental Impact Assessment Directive for Local Planning Authorities | |||
| Originator: | Communities and Local Government | |||
| Date: | 2004-04-19 | View | ||
|
This note, in the form of answers to frequently asked questions, offers a brief and
basic introduction to the Directive, the Regulations and planning authority
responsibilities.
The messages are clear: 1. the Directive is not open to narrow interpretation - the UK Courts will interpret the Directive in the European sense i.e. as having wide scope and broad purpose; 2. do not assume a project is excluded simply because it is not expressly mentioned in either the Directive or the Regulations. For example, neither the Directive nor the EIA Regulations refer to specifically "housing development" or school . But it would be a mistake to consider that housing development or building a school does not fall within "urban development projects"; and, 3. where planners are unfamiliar with the EIA Regulations, they should consult with other statutory bodies and, if in doubt, seek legal advice.

| Date: | Winter 2007/8 | View | ||

In R (on the application of Mortell) v Oldham Metropolitan Borough Council [2007]
EWHC 1526
(Admin) the High Court concluded that failure to fully consider EIA criteria before
adopting a screening
decision that a development fell outside the EIA regulations meant that the decision
was invalid and the
development's planning permission, granted on the back of that screening decision,
was quashed.

The 2008 Regulations recognise that an EIA may be necessary at the Reserved Matters
stage.
In essence they provide for an EIA to be carried out for a proposed project at
reserved matters stage, where either EIA was not carried out at the earlier stage of
outline planning permission,
or additional significant environmental effects came to light after outline planning
permission was granted.

| Title: | Chromosomal congenital anomalies and residence near hazardous waste landfill sites | |||
| Originator: | Lancet | |||
| Date: | 2002-01-26 | View | ||

Previous findings of the EUROHAZCON study showed a 33% increase in risk of
non-chromosomal anomalies near hazardous waste landfill sites. Here, we studied 245
cases of chromosomal anomalies and 2412 controls who lived near 23 such sites in
Europe. After adjustment for confounding by maternal age and socioeconomic status, we
noted a higher risk of chromosomal anomalies in people who lived close to sites (0-3
km) than in those who lived further away (3-7 km; odds ratio 1.41, 95% CI 1.00-1.99).
Our results suggest an increase in risk of chromosomal anomalies similar to that
found for non-chromosomal anomalies. The full text of the article can be found on the ResearchGate web site here .

This report considers evidence of potential health effects in populations potentially
exposed to chemicals emitted from landfill sites.
The paper states " . . . . there is the potential for hydrogen sulphide to be the cause of respiratory problems. While the evidence is not strong currently, there is a potential for a causal relationship. This may be an emission that could be monitored more frequently around landfill."

Friends of the Earth Wales is calling for more funding, better information, stronger
legislation, and
improved regulation to protect people's health and that of the natural world.

Residents living near a notorious hazardous waste landfill site in Newport were
astonished
when council planners decided that a full risk assessment was not required before
granting
planning permission to build a new primary school on the severely contaminated site.
Now, as building work on the school proceeds, campaign groups are seeking clarity over who will be responsible for monitoring the health of those who attend the school, what records will be maintained, and how these records will be used.

| Originator: | Newport Council & URS Corporation | |||
| Date: | 2002-04-18 | View | ||
|
At the request of Newport Council, this document sought to dispel concerns raised
by the Children's Commissioner about
the risks to public health caused by toxic substances released by hazardous waste
landfill sites.
In its conclusions, this report states "... the findings of the risk assessment indicate from the data reviewed and collected by URS that there is no reason on human health grounds why the site cannot be redeveloped for the stated purpose once suitable remedial works have been undertaken."
This seems to be saying 'go ahead and build this landfill school' but,
importantly, then goes on to say: It is at this point that we are told that the sampling exercises undertaken to date were insufficient to characterise the site as a whole. The upshot being that this report was incapable of giving Newport Council the necessary assurances about the suitability of this site for development. Indeed, the report final paragraph is saying 'the results of further investigations could invalidate our whole report'. Which is precisely what happened as a result of subsequent and more effective site investigation methods. See below for an update.

This report extract (pages 52 to 71) provides some of the best contaminated land
information relating to the north Glebelands. But this is yet another
report relying on sampling methods that are inadequate to characterise the site
as a whole.
Nevertheless, the findings are very serious and cast doubt on the continued use of the Glebelands in its present condition for recreational purposes. The findings of this report about the north Glebelands provides the best indication yet of the substances that probably also exist in the fill material in the south Glebelands area. Also provides an indication of the range of pollutants that continue to leach into the River Usk SSSI.

This second newsletter was accompanied by a Newport Council form called
'Questionnaire for Parents' prepared in the style of a Hobson's Choice: 'take it
or leave it'. The newsletter and questionnaire was intended only for the
parents
of children attending the Durham Road schools.
Completion of the questionnaire by parents was no doubt based on the biased and misleading information provided on the form itself and within the text of the accompanying newsletter. Of course, Newport Council got the result that they had engineered so carefully. Newport Council later used the results of this dubious survey of parents to imply that the survey results reflected local views in general.

This newsletter mentions that Newport Council has arranged a meeting with
Peter Clarke, the Children's Commissioner to discuss his concerns about building

leader of Newport Council,
Harry Jones would be telling councillors who were members of the planning
committee to leave the meeting on the grounds that they might be influenced by
what Mr Clarke has to say.

States that in May 2004, the Council and Vinci gained planning permission for
the schools. There will be a 270-place infant school with nursery and 360-place junior school on site. There will also be a flood lit all weather pitch and new community changing facilities. A second access will be provided along Riverside Boulevard to make the school premises more accessible. "We are on schedule so far and are aiming to stay on track , said Council Leader Bob Bright. This might have been a bit premature because the press releases concludes by saying "The project is aiming for a signing date of April 2005, which would allow the school to open by September 2007."

Members of Newport Council cabinet called contractors working on the new Glan Usk
Primary school to
a special meeting after residents raised concerns about the project.
Councillor Townsend said: "We have always been given assurances that this site will be safe and more than suitable for a school and homes. The update we have heard reinforces that. We were able to challenge the contractors and they have satisfied us that the work is meeting the safety standards set out for the project." However, it is not clear which members of Newport Council cabinet, if any, have the qualifications necessary to undertake an effective and detailed challenge of their contractors in key technical areas relating to environmental protection and public health. It is not clear that those residents who had raised concerns were present when the contractors were 'challenged' during the meeting.

On his website, under the title Monsanto's Shame , Paul Flynn MP (Newport West)
wrote in March 2007: "It was always a bit embarrassing complaining about Rechem's burning of toxic waste - when the PCBs involved were manufactured in Newport. "What is worse is the news that Monsanto illegally dumped toxic waste from Newport in a site at Brofiscin quarry, at Groesfaen near Cardiff. Dangerous chemicals are leaking from the site. It could cost 100 million to clean up the chemicals that include the derivative for Agent Orange. PCBs were manufactured up to 1977 in Newport - six years after a ban in the USA. "The first report of the danger tip was made in 1972 when nine cows died on a local farm. Since then it has been a sad story of delay, cover-up and incompetence."

Statement by Peter Clarke, Children's Commissioner for Wales, concerning his
views about building schools on landfill sites.
Mentions the proposed Glebelands landfill school, and advises the local authority not to proceed, concluding "It is therefore my view that these schemes should not proceed in their present form, and that the Local Authorities in question pursue other means to achieve their admirable desire to improve the educational environment of the children in their area."

Relates to a project to build a school on a brown field site in Conwy, north
Wales.
The document needs to be read in its entirety. But Dr Hall wrote "A school is a focus for young people and young families and the Assembly has set out specific Core Aims for Children and Young People. That section of the population is perceived to be more vulnerable which adds to public anxiety. The concerns about health that are being raised require that the way risk is assessed and managed is understood by the community. Long term anxieties may result if this is not done with the involvement of local people. Current planning mechanisms provide an uneasy place for health issues and my staff are working in the project commissioned by the Cabinet Sub-Committee on Children and Young People to examine this. I urge renewed engagement of local agencies to address the points I have made in giving my views."

The foreword by the Rt. Hon. Rhodri Morgan AM, First Minister stated, "Peter Clarke has already shown how he is influencing the policy agenda wherever it impacts on children and young people. One of his first public announcements concerned the effect building schools on former landfill sites might have on children s health. As a direct result of the Commissioner s concerns, and discussion in the Cabinet Sub-Committee on Children and Young People, the Welsh Assembly Government is researching into ways in which the planning system can consider health issues more appropriately."

The National Assembly for Wales has a duty under section 121 of the
Government of
Wales Act 1998 to promote sustainable development in the exercise of its
functions,
that is, in everything it does. The Act requires the Assembly to make a
Scheme setting out how we
propose to implement the duty, to consult before making it, keep it under
review, publish an
Annual report on progress and evaluate its effectiveness every four years.

Some may regard the answer from the Minister as window dressing. There
appears to be no specific guidance to regulate
the building schools on landfill sites. Note that the answer includes the
statement "The planning
authority does not have a duty of care to landowners."
